These Terms of Service ("Terms") govern your use of the David mobile application and the website at thedavidapp.com (together, the "Service"), provided by Foundry24, LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
You must be at least 13 years old to use David. If you are under the age of majority in your jurisdiction, you must have a parent or guardian’s permission.
You are responsible for keeping your account credentials secure and for any activity that happens under your account. Tell us immediately at hello@foundry24.io if you believe your account has been compromised.
David offers a free tier and optional Premium subscriptions. Premium is billed through the App Store and renews automatically until you cancel. You can manage or cancel your subscription in your Apple ID Subscription settings. Except where required by law, subscription payments are non-refundable.
Devotional content, Scripture quotations, and other materials provided by David are for personal spiritual formation. They are not a substitute for professional, medical, or mental-health advice. Journal entries you create belong to you; you grant us a limited license to store and display them to you within the Service.
Don’t misuse the Service. Specifically, don’t attempt to reverse-engineer the app, interfere with the infrastructure, scrape content in bulk, or use the Service to harass, harm, or deceive others. We may suspend or terminate accounts that violate these Terms.
The Service is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. To the fullest extent permitted by applicable law, Foundry24, LLC and its suppliers disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, accuracy, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Service is free of viruses or other harmful components; or that any information, devotional content, Scripture reference, AI-generated text, prayer, reflection question, or other material available through the Service is accurate, complete, reliable, current, or suitable for any particular purpose. Devotional content is provided for personal spiritual formation only and is not medical, mental-health, legal, financial, counseling, or professional advice of any kind. You should consult a qualified professional for any such advice. Your use of the Service is at your sole risk.
To the fullest extent not prohibited by applicable law, in no event shall Foundry24, LLC, its affiliates, officers, directors, employees, agents, licensors, or suppliers be liable for personal injury, or any incidental, special, indirect, exemplary, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, loss of goodwill, cost of substitute services, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Service, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if Foundry24 has been advised of the possibility of such damages.
In no event shall the total liability of Foundry24, LLC to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty U.S. dollars (US$50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
You acknowledge that Foundry24 has set its fees and entered into these Terms in reliance on the disclaimers of warranty and limitations of liability in these Terms, that they reflect a reasonable allocation of risk between the parties, and that they form an essential basis of the bargain between you and Foundry24.
You agree to defend, indemnify, and hold harmless Foundry24, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (a) your use of or access to the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual-property or privacy right, or (d) any content you submit through the Service, including your journal entries.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. You agree that any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use of the Service after the changes take effect constitutes acceptance.
